1. Acceptance of terms and conditions

By placing an order, the client acknowledges having been made aware of the specific conditions of sale outlined and expressly declares to accept them unreservedly.

The General Terms and Conditions of Sale herein govern the contractual relationship between Bijouterie Paul A. Langlois Ltd. and its client, both parties accepting them unreservedly. These General Terms and Conditions of Sale prevail over any other conditions present in any other document, except express and written prior exemption.

2. Products

Products offered for sale are generally available in-store. For products temporarily out of stock, a delay of several weeks may be necessary to produce a piece of jewelry according to its precise nature.

The maximum waiting time is 4 weeks. In the case of an order for an unavailable product, the client will be informed without delay via their customer account and by email.

Prices for jewelry can vary depending on the value of the gold, and the size and purity of the diamond.

Certain pieces of jewelry are offered in limited quantity and the prices are subject to change without notice.

3. Online Orders

To place an order, the customer must first identify himself by filling in a form with all necessary information related to his identity such as first and last names, phone number, mailing and email addresses and the correct billing and shipping address. All product information offered to the customer will be in French and in English. 

After making his choices, the customer will validate his order by clicking on “Confirm Order” to express engagement and acceptance of the General Terms and Conditions of Sale.

At that moment, the order will be registered and an order number communicated to the customer, followed by a confirmation on-screen and by email. The data recorded by Bijouterie Paul A. Langlois Ltd. constitutes proof of the nature, content and date of the order. No unilateral cancellation of the order will be accepted without the prior agreement of Bijouterie Langlois Ltd.

However, if you change your mind, you may return the item prior to 7 days following the date of delivery but only if Bijouterie Paul A. Langlois Ltd. has been notified and the return has been approved. Once the item has been returned, you will be reimbursed as long as the prescribed conditions have been met.

Special orders are neither exchangeable nor refundable. Definition of “Special orders”: All rings having been ordered with a request for sizing or any other modification.

Shipping expenses incurred to return an item will be at the customer’s expense. Bijouterie Paul A. Langlois Ltd. reserves the right to refuse or to not reimburse an item returned if the packaging has been opened or the product damaged in any way.

4. Mode of Delivery

Delivery will be made by Canada Post to the address specified by the customer at the time of purchase. To confirm reception of the order, a signature will be required in exchange for the parcel.

Delivery can only be made once the order is validated and full payment received. The relevant bank payment center will have pre-approved the payment. In case of a decline by the payment center, the order will automatically be cancelled.

In addition, Bijouterie Paul A. Langlois Ltd. reserves the right to refuse all orders from a customer with whom there is an ongoing dispute.

Delivery charges are calculated depending on where you live and the size of your order. You can check these at any time under Conditions of Delivery on our website.

Delivery address: When placing the order, the client must confirm a delivery address where delivery can be made during business hours. In the case of absence during delivery, the carrier will leave a delivery notice indicating the location of the Canada Post office or postal center the parcel may be collected from.

5. Delivery Times

After preparation by our Logistics Department, the order is normally delivered within 24 to 48 business hours in the province of Québec by Canada Post transport. However, please note that the availability of certain products may affect delivery times.
 
A delay in delivery due to an out of stock condition cannot under any circumstances lead to compensation or to damages and interest of any kind. If an out of stock condition exists, the replenishment lead time is approximately 2 to 4 weeks. The delivery periods will begin from the date the product is considered in stock.
 
Bijouterie Paul A. Langlois Ltd. is released from all and any liability in the event of major force or exceptional circumstances (natural disaster, epidemic, strike, lock-out, etc.) delaying or prohibiting the delivery of goods. Bijouterie Paul A. Langlois Ltd. assumes no responsibility for the failure to meet delivery dates announced by the carrier itself.
 
Additionally, Bijouterie Paul A. Langlois Ltd. may not be held liable and no compensation may be claimed in the event of a delay due to the formal bankruptcy of the carrier. Any cancellation, regardless of the motive, approved by Bijouterie Paul A. Langlois Ltd. shall carry the right to the only repayment of sums paid. No compensation relating to this cancellation can be demanded.

6. Prices

All prices are shown in the selected currency excluding applicable taxes. Packaging costs are included. The price indicated on product sheets does not include the transport, which is calculated based on your area of residence.

The price indicated on the confirmation of order is the final price with all taxes included. This price comprises the cost of the product as well as handling fees, packaging and conservation of the product and transport charges.

Bijouterie Paul A. Langlois Ltd. reserves the right to change its product prices at any time without prior notice. Products are invoiced at the price in effect at the time the order is validated by full payment. The client will be advised if there is a change in price. Any cancellation following a price adjustment will be accepted.

7. Complaints

By signing the delivery note, the client accepts the product as delivered in good condition and therefore no claim for damages suffered during shipping will be accepted. The client is encouraged to verify the contents of the package upon reception.

A 48-hour window is allotted to report any damages to Bijouterie Paul A. Langlois Ltd. so that a claim can be filed with Canada Post. Any complaint not made in accordance with the rules defined above and within the time limits allowed cannot be taken into account and will indemnify Bijouterie Paul A. Langlois Ltd. of all liability to the customer.

The customer must verify the state of the parcel and goods upon reception and in the event of damage or missing goods must specify the relevant issues in writing on the shipping voucher and confirm these by registered letter, phone or email to Bijouterie Paul A. Langlois Ltd. within 24 hours of delivery

Any return of goods will require prior approval from Bijouterie Paul A. Langlois Ltd. Keep in mind that all jewelry having been resized or otherwise modified is non-refundable. All shipments returned without prior approval will be held at the customer’s expense, risks and perils, and transport, storage and handling of goods fees will be at the expense of the customer. In all cases, the return of goods will be carried out at the expense, risks and perils of the customer.

8. Invoicing

A detailed invoice with details of applicable taxes will be placed in the parcel sent to the customer.

9. Payment Type

Payment can be made by:

Credit Card
Visa, MasterCard or American Express by means PayPal on the website, or by telephone.

Money Order
The customer may send a money order, made out to « Bijouterie Langlois ltée. » for the order amount invoiced plus applicable taxes (shipping costs included), with a brief note on the back of the money order listing the order number and order details. The money order can then be mailed to:

If payment has not arrived within 7 days, the order will be cancelled.

10. Loss or Theft of a Parcel

In the case of loss or theft of a parcel due to a problem with the carrier, it is imperative that the customer report it to Bijouterie Paul A. Langlois Ltd. as soon as possible. The report must be sent by email, along with a sworn statement stating that the customer has not received the parcel.

An investigation will then be initiated by Bijouterie Paul A. Langlois Ltd. with the carrier. Bijouterie Paul A. Langlois Ltd. will make all related information regarding the investigation available to the customer.

It can take at least 3 weeks for an investigation regarding loss or theft to be concluded. If the investigation concludes the parcel has in fact been lost, Bijouterie Paul A. Langlois Ltd. will proceed with either a second delivery or a reimbursement either by cheque or store credit.

11. Applicable Law

This contract is subject to the laws of the province of Québec. The language of this contract is French. In the event of a dispute, Québec courts shall have sole jurisdiction.

12. Personal, Nominative and Private Information

Information and data concerning the customer is necessary for Bijouterie Paul A. Langlois Ltd. to manage its purchase orders and communicate with its customers. Please familiarize yourself with our policy on the protection of the personal information you entrust to us.

Retention of Personal Information

Your personal information will be retained by Bijouterie Paul A. Langlois Ltd. for at least 10 years in compliance with legislative requirements.
